Shipping Policy Overview
Enstitü OÜ (doing business as “3DMoose”) (the “Company”), a global provider of digital and physical maker kits (the “Products”), ships orders to destinations worldwide. This Shipping Policy sets forth the terms, conditions, and legal disclaimers applicable to the shipment and delivery of Products ordered through the Company’s website (the “Site”). This policy is governed by applicable international conventions (including the Convention on the Contract for the International Carriage of Goods by Road (CMR), the Warsaw Convention, and the Montreal Convention), regional and local laws, and the contractual terms of the carriers selected.
Carriers and Methods of Shipment:
The Company utilizes reputable international and local carriers, including but not limited to UPS, DHL, FedEx, TNT, and national postal operators for carriage of physical Products. The selection of carrier for each order is based on destination, cost efficiency, delivery speed, and the nature of the Products. Carrier choice may vary without prior notice, provided that the Company uses commercially reasonable efforts to ensure timely and safe delivery.
Delivery Timeframes and Estimates:
Estimated delivery times are provided at checkout and are based on carrier-provided transit estimates. Delivery times typically range from 5 to 15 business days for most destinations. For remote or rural locations, delivery may take longer. Business days exclude weekends and public holidays in both the origin and destination countries. These estimates are non-guaranteed; actual delivery may occur before or after the estimated timeframe.
Shipping Costs and Free Shipping Thresholds:
Shipping costs are calculated at checkout based on the User’s shipping address, the weight, dimensions, and declared value of the Products, and the selected shipping method. The Company may offer promotional free standard shipping on orders exceeding a specified threshold, as published on the Site. Free shipping applies solely to standard delivery methods and does not cover expedited or premium services unless otherwise stated.
Customs, Import Duties, and Taxes:
For international shipments, orders may be subject to customs clearance procedures, import duties, taxes, tariffs, and other government levies imposed by the destination country. These charges are borne by the User, unless explicitly included in the order summary. The Company provides an estimated breakdown of such charges where possible, but Users are responsible for any additional fees assessed by customs or local authorities. Failure to pay customs charges may result in shipment delays, returns, or disposal of the Products by customs authorities.
VAT and Tax Compliance:
For shipments to the European Union, United Kingdom, and other jurisdictions where Value Added Tax (VAT) or Goods and Services Tax (GST) applies, the Company will collect and remit applicable taxes in accordance with local tax regulations. The invoice and shipping documentation will reflect any collected VAT or GST. For business customers purchasing Products for resale, it is the User’s responsibility to provide a valid VAT registration number to facilitate zero-rating or tax exemption where permitted by law.
Order Processing Times:
Upon receipt of an order, the Company processes orders during normal business hours (Monday through Friday, excluding public holidays in Estonia). Orders placed before 3:00 PM EEST on a business day will be processed and dispatched within one business day, subject to Product availability and payment authorization. Orders placed after the cut-off time or on non-business days will be processed on the next business day.
Tracking and Shipment Notifications:
Once an order is dispatched, the Company sends shipment confirmation via email, including carrier information and a tracking number. Users can monitor the status and location of their shipment directly through the carrier’s tracking portal. If Users do not receive a tracking notification within 48 hours of order confirmation, they should contact Customer Support.
Transit Insurance:
The Company arranges insurance coverage for international shipments up to the declared value of the Products. Insurance covers loss or damage occurring during transit, subject to the carrier’s terms and conditions and the insurance policy provisions. In the event of loss or damage, Users must file a claim with the carrier and notify the Company within 7 days of delivery for assistance with the claims process.
Delivery Failures and Reattempts:
If delivery fails due to an incorrect address, User unavailability, or refusal to accept the delivery, the carrier may return the Products to the Company or attempt redelivery. Additional delivery fees, redirection costs, and customs re-clearance charges are the responsibility of the User. The Company is not liable for shipments returned to sender due to User error or failure to accept delivery.
Force Majeure:
The Company shall not be liable for any delay or failure in delivering Products caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, strikes, pandemics, government actions, or carrier interruptions. In such cases, delivery times are extended by the duration of the force majeure event.
Returns and Replacements for Shipping Errors:
If the wrong Products are shipped or the Products are defective, Users must notify the Company within 30 days of delivery. The Company will provide return instructions and arrange for replacement Products or issue a refund, including any return shipping costs, subject to inspection and verification.
Address Changes and Redirection:
Users may request to change the delivery address or redirect the shipment in transit by contacting Customer Support and the carrier directly. Such requests are subject to carrier approval and may incur additional charges. The Company does not guarantee the success of redirection requests.
Compliance with Export Controls:
All international shipments are subject to export control laws and regulations, including the U.S. Export Administration Regulations (EAR), European Union Dual-Use Regulation, and any applicable sanctions maintained by the Office of Foreign Assets Control (OFAC). Users warrant that they will not re-export or transfer Products in violation of applicable export laws.
Environmental and Sustainability Initiatives:
The Company is committed to minimizing its environmental impact by optimizing packaging materials, consolidating shipments, and selecting carriers with carbon offset programs. Users may opt for carbon-neutral shipping options where available, subject to additional fees.
Legal Disclaimers and Limits of Liability:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY’S LIABILITY FOR ANY SHIPPING-RELATED CLAIMS SHALL NOT EXCEED THE PRICE PAID FOR THE PRODUCTS AND SHIPPING FEES INCURRED BY THE USER. IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM SHIPPING.
Governing Law and Dispute Resolution:
This Shipping Policy shall be governed by and construed in accordance with the laws of the Republic of Estonia. Any disputes arising out of or relating to shipping shall be subject to the exclusive jurisdiction of the courts of Tallinn, Estonia, unless mandatory local consumer protection laws require otherwise.
